Police asked McHugh to perform a field sobriety test, and he failed it. At that time, he was placed under arrest for driving while intoxicated. His arrest was processed on the following charges: driving while intoxicated (first offense), aggravated DWI with a blood alcohol level of .18 or more with no priors, and a stopping/standing/parking violation.
